1. Acceptance of Terms

By accessing or using Pick Party (“the App”), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the App.

2. Age Requirement — 18+ Only

Pick Party is intended solely for adults aged 18 and older. You must be at least 18 years old to create an account or play.

By accessing or using the App, you represent and warrant that you are at least 18 years of age. We do not knowingly permit anyone under the age of 18 to register for an account, play, or otherwise use Pick Party. If we become aware that a user is under 18, we reserve the right to suspend or terminate that account and forfeit any associated virtual currency or items.

3. Account Requirements

To use Pick Party, you must:

Be at least 18 years old
Provide accurate and complete registration information
Keep your account credentials secure
Be responsible for all activity under your account

4. Not Gambling

Pick Party is a free-to-play sports prediction game for entertainment purposes only. No real money is wagered, won, or lost through gameplay. Virtual tokens and other in-app items have no real-world monetary value and cannot be redeemed, exchanged, or cashed out for real currency, goods, or services. Pick Party does not constitute gambling, sports betting, or any form of wagering under any applicable law.

5. In-App Purchases

Pick Party offers optional in-app purchases including season passes and token packs. By making a purchase, you agree to the following:

All purchases are processed through the Apple App Store
Purchases are final and non-refundable through the App
For refund requests, please contact Apple Support directly
Subscription purchases auto-renew unless cancelled before the renewal date
You can manage subscriptions in your Apple ID account settings

6. Apple Standard License Agreement (EULA)

The App is licensed, not sold, to you for use only under the terms of these Terms of Service together with Apple’s standard Licensed Application End User License Agreement (the “Apple Standard EULA”). Your license to use Pick Party on any Apple-branded device is governed by the Apple Standard EULA, which is available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/.

You acknowledge that these Terms are entered into between you and Pick Party only, and not with Apple. Apple is not responsible for the App or its content, and is not responsible for providing any maintenance or support for the App. In the event of any conflict between these Terms and the Apple Standard EULA, the Apple Standard EULA will govern solely with respect to your use of the App on Apple devices, to the extent required by Apple.

7. Virtual Currency and Items

Tokens and other virtual items in Pick Party:

Have no real-world monetary value
Cannot be exchanged for real currency, goods, or services
Are licensed to you, not sold, and remain the property of Pick Party
Are for entertainment purposes only within the App
May be forfeited if you violate these terms
May be modified, adjusted, or removed at our discretion

8. User Conduct

When using Pick Party, you agree not to:

Use offensive, abusive, or inappropriate language in group names or display names
Attempt to manipulate or exploit the App or other users
Create multiple accounts to gain unfair advantages
Use automated tools or bots to interact with the App
Reverse engineer, decompile, or disassemble any part of the App
Violate any applicable laws or regulations

9. Content and Intellectual Property

Pick Party and its content, features, and functionality are owned by Pick Party and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our permission.

10. Termination

We reserve the right to suspend or terminate your account at any time for violations of these terms or for any other reason at our discretion. You may also delete your account at any time through the App settings. Upon termination, your right to use the App ceases immediately, and any virtual currency or items associated with your account will be forfeited.

11. Disclaimer of Warranties

Pick Party is provided “as is” and “as available” without warranties of any kind, whether express or implied. We do not guarantee that the App will be error-free, uninterrupted, or meet your specific requirements. Sports data and game results are provided for entertainment purposes and may not always be accurate or up-to-date.

12. Limitation of Liability

To the maximum extent permitted by law, Pick Party and its owners, operators, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to loss of data, loss of profits, or interruption of service.

13. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the United States. Any disputes arising from these terms or your use of the App shall be resolved in accordance with applicable law.

14. Changes to Terms

We may update these Terms of Service from time to time. Continued use of the App after changes constitutes acceptance of the new terms. We encourage you to review these terms periodically.
